What are a Brisbane real estate agent's obligations under the Residential Tenancies and Rooming Accommodation Act 2008?
Acting on the lessor's behalf, the agent must ensure every QLD rental meets the smoke alarm standard before each new tenancy and within 30 days before the start of the tenancy: photoelectric, interconnected alarms in every bedroom, hallway and storey, manufactured within 10 years, tested and operational. The agent must also test alarms at every change of tenancy and confirm to the incoming tenant that alarms are compliant. We provide a dated compliance certificate for every property — exactly what your office and the lessor's insurer need on file.
What's the smoke alarm wording on the Form 17 (Form 18a) tenancy agreement?
Standard QLD lease forms (the General Tenancy Agreement Form 18a, sometimes referred to in agency shorthand as 'Form 17 wording') include clauses confirming the lessor's obligations under the Residential Tenancies and Rooming Accommodation Act 2008 to install and maintain compliant smoke alarms, and the tenant's obligations to test monthly and report faults. The lessor must sign confirming compliance is in place at start of tenancy. Our compliance certificate is the supporting document agents attach to the property file to evidence that obligation.
When does smoke alarm compliance trigger for a sale vs a lease?
Both triggers have applied since 1 January 2022. For a sale: the seller must have full photoelectric-interconnected compliance in place at settlement (it's commonly addressed in the contract Special Conditions or via a pre-settlement inspection). For a lease: every new tenancy and the start of every renewed lease requires compliance confirmed within 30 days. From 1 January 2027, the same standard applies to every owner-occupied home regardless of sale or lease — so agents prospecting in the market should expect every listing to need a check.
